1. Introduction

Welcome to Panda FPL ("we," "our," or "us"). By using our WhatsApp-based Artificial Intelligence assistant (the "Service") accessible via pandafpl.com and fplpanda.com, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.

2. Description of Service

Panda FPL is a conversational AI tool designed to provide data-driven insights, analytics, and entertainment for Fantasy Premier League (FPL) managers.

• No Affiliation: Panda FPL is an independent tool and is strictly not affiliated with, endorsed by, or sponsored by the English Premier League, Fantasy Premier League, or any of its participating clubs.
• Entertainment Purposes: All transfer suggestions, captaincy picks, and data analysis are provided for entertainment and informational purposes only. We do not guarantee mini-league victories, rank increases, or financial returns.

3. Accounts and Registration

To use the Service, you must register by interacting with our WhatsApp bot and providing a valid FPL Team ID. You are responsible for maintaining the security of your WhatsApp account. Your account is tied to your specific mobile number and cannot be transferred.

4. Panda Credits and Payments

The Service operates on a "Pay-As-You-Go" model using virtual "Panda Credits" (CR).

• Purchasing Credits: Credits can be purchased via M-Pesa (for Kenyan users) or via our Merchant of Record, Polar.sh (for Global/EU users via Card/Apple Pay/Google Pay).
• Taxes: For global transactions processed via Polar.sh, they act as the Merchant of Record and handle all applicable VAT/Sales Tax calculations.
• Consumption: Credits are deducted automatically per query based on the computational resources required.
• No Refunds: Because Panda Credits are digital, consumable goods, all sales are final. We do not offer refunds for unused credits or for credits consumed during normal interactions with the AI.

5. Acceptable Use and Moderation

You agree not to abuse, spam, or attempt to reverse-engineer the Service.

• Profanity & Abuse: We maintain a strict moderation policy. Directing severe profanity, hate speech, or abuse at the AI assistant will result in a "strike."
• Automated Bans: Accumulating 5 strikes will result in an automatic, non-negotiable 24-hour ban from the Service.

6. Limitation of Liability

To the maximum extent permitted by law, Panda FPL and its founder shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the Service, including but not limited to lost FPL points, failed mini-league bets, or API downtimes.
